In some cases, however, you and the other driver could each be partially responsible for the accident. Illinois has a modified comparative fault system. Under a modified comparative fault system, the injured party cannot recover damages if a jury finds that he or she is 51 percent at fault or more. If the other driver is found to be more at fault, your recovery will be reduced by the percentage you are found to be at fault.

Take the following example: You were in an accident with another driver. At trial, the jury finds that you had $100,000 in damages. The jury also finds that the other driver was 70 percent responsible for the accident and you were 30 percent at fault. Therefore, you would be entitled to receive $70,000 in damages.
